Appointment of Arbitrators & Umpires

  1. At any time after the acceptance of a dispute for arbitration, the Committee may appoint arbitrators to decide upon it, and shall thereupon notify all parties of the appointment. If and when an umpire is appointed, his appointment also shall be notified to all parties.

  2. Unless the Committee otherwise decides, two arbitrators shall be appointed. Arbitrators so appointed shall be independent and impartial, and shall not act as advocates for or negotiators on behalf of any party.

  3. The Committee may appoint the same or different arbitrators or umpires upon different parts of a dispute; and may appoint the same arbitrators or umpires upon cognate disputes between different parties, to the end that they may use knowledge acquired in one arbitration for the purposes of another; and may, for the purpose of deciding whom to appoint as arbitrator or otherwise, take legal advice ( at the expense of the parties) upon any dispute either before or after the arbitrators are appointed.

  4. If an arbitrator or umpire appointed under these Rules dies, or is or becomes disqualified or unable to act, or declines to act, or fails to act for seven days after notice from the Committee or in the opinion of the Committee persistently fails to act with proper speed or obstructs the reference; or if an arbitrator or umpire is objected to by a party, and in the opinion of the Committee the objection is reasonable; then the Committee may appoint another to act in his stead or ( in the case of an arbitrator) may appoint an umpire to enter forthwith upon the reference. A party objecting to an arbitrator or umpire must do so within seven days of notification. He may require that the objection be considered by the Committee (but this without prejudice to the operation of Rule 2(c) in any other case). A replacement arbitrator or umpire shall give such effect as he thinks fit to materials and information collected by, and decisions reached and opinions formed by, his predecessor.
