4. Commencement of Arbitration
Arbitration under the Rules is commenced by delivery to the Chamber or the Committee by or on behalf of a party to the proposed arbitration of a Request for Arbitration which must be accompanied by the following, namely :-
any one of the following documents :-
- an Arbitration Agreement pursuant to clause 3 hereof ; or
- any other agreement for arbitration to be held under these Rules; or
- an order of a Court that an arbitration be held under these Rules; and
- an Arbitration Agreement pursuant to clause 3 hereof ; or
- a short description of the claims of the parties; (or Statement of Case in accordance with Rule 6a) and
- the Registration Fee required pursuant to clause 12 of the Rules.
- Where there is a valid agreement for arbitration under the Rules, and an arbitration is commenced in the sense of these rules which was not previously commenced within the provisions of the English Limitation Act 1939 or any subsequent Limitation Act for the time being in force, no party may thereafter dispute that the commencement under these Rules was a commencement for the purpose of that Act.
